These pooled trust accounts hold client funds that are so small in amount or held for such a brief period that it is not possible for the funds to benefit individual clients. These funds, along with monies raised through the Campaign for Equal Justice and other fundraising efforts, are disbursed according to grant criteria developed by the nine-member Board of Trustees pursuant to the Washington Supreme Courts opinion and rule. Eligible Program Areas The Foundation funds programs that provide civil legal aid to low-income people in Washington State. The Foundation gives priority to programs and services that aid vulnerable individuals, families and groups who experience multiple barriers to accessing the justice system and who require specialized focus in areas where other legal aid providers are unable to meet the existing need. Applicant Responsibilities Grant applicants must: Demonstrate fiscal responsibility and integrity Agree to sign and follow Foundation grant assurances Open their financial records to review, upon request of the Foundation, during the application process and thereafter if a grant is awarded Agree that their applications become the property of the Foundation and that the Foundation reserves the right to use any or all ideas presented whether or not an application is accepted for funding. Guidelines Trustees will use the following guidelines, with exception if necessary, to assist in the grants decision making process. The Foundation grants funds in a manner consistent with the 2006 Plan for the Delivery of Civil Legal Aid to Low Income People in Washington State and the implementation plan adopted by the ATJ Board. The Foundation favors leveraging the use of funds by using volunteers and by seeking diverse funding sources (such as attorney fees, city and county funding and other grants) to the extent those efforts do not conflict with participation in the unified state fundraising Campaign for Equal Justice. The Foundation gives greater weight to applicants with a prior history of high quality service delivery. The Foundation gives greater weight to applicants who work to develop cooperative efforts between Foundation grantees within a service area. The Foundation prefers to fund applicants who can demonstrate community support for their projects. The Foundation funds programs that practice and reflect inclusion, diversity and multicultural competence. The Foundation funds applicants to achieve broad geographic and demographic distribution of funds throughout the state. In reviewing grants for renewal, the Foundation gives greater weight to previous Foundation recipients who have successfully used grant funds. The Foundation encourages the development of new and innovative programs that are consistent with the 2006 State Plan for the Delivery of Civil Legal Aid (see guideline #1) and will have a broad impact on the legal problems of low-income people. Restrictions The Foundation will not fund individuals, political campaigns, religious organizations for the purpose of furthering their religion, or constitutionally mandated legal services. Client Eligibility Clients must be low-income in order to receive services funded by the Foundation. Low-income is defined to be at or below 200% of the federal poverty guidelines. Exceptions must be authorized by the Foundation. Grant Decisions The Legal Foundation Board of Trustees is responsible for making final grant decisions. Funding determinations will be based primarily on a written application. The trustees may, at their discretion, request supplements to the application and make site visits. The trustees may request applications from potential providers in priority funding areas where no grant application has been received. Grants are made pursuant to a written contract between the recipient and the Foundation. Trustees require all recipients to submit periodic reports regarding the use of grant funds. Legal Foundation of Washington Case Definitions Full Representation means that a staff or volunteer attorney represents an eligible client from the time the case is referred or assigned until the legal matter is concluded. Unbundled Legal Services are provided by an attorney who agrees to represent an eligible client in a particular element or phase of a legal case but does not take the entire case from beginning to end. For example, in a domestic violence case, an attorney may represent a client only through the issuance of temporary orders. Advice and Counsel means the provision of legal advice by an attorney to an eligible client without the expectation of additional services. Advice and counsel typically takes place in a clinic setting and may involve brief review of a legal document followed by a recommendation on the action needed to address a legal problem. Brief Services means a legal service that is provided by an attorney for an eligible client that is concluded within a few days or weeks of intake. Brief services could include making a telephone call, writing a letter, or preparing a routine legal document such as a will. Community Education refers to law-related events that are instructional in nature but where no specific legal advice is recommended to any individual clients. Pro se classes that do not include an advice and counsel component, speakers bureaus, and presentations on general areas of the law are all examples of Community Education.
